SO this really sux. This dude named John C also is putting music out in a kind of similar style as me and Beatport is lumping us together. I don't want his music ( lumped with mine. This is really annoying me. The song "Gain" is his. I messaged him and Beatport. Lets see what happens. I really an alias sigh.

I had the same issue once with Cereal Killaz - someone had the Cereal Killaz name used as the name of the remixer for one of their tunes. I contacted my rep at INgrooves and told them about it, and two hours after I discovered it, they had the name removed from the song... dunno if that will help you tho

You're only trying to find out who pronounces it that way so you don't feel stupid for having pronounced it incorrectly until last week.

LOL she shoulda left that... woulda been funny... but only reason I asked is cause I was trying to think of another funny thing, John C could call himself and thought of John Vitamin C... which made me remember there was someone called Vitamin C already that was only around for like a minute... so I wondered if anyone else remembered to...

i dunno. trying to spell out a mispronunciation. i remember when your first tune got featured on loxy, ink, or dylan's webcast (can't remember whose), you were all stoked that they properly enunciated all of the syllables properly: per-peh-tyu-um

Per-pech-yewm. It's not really a mispronunciation. Just an accent. You're not good at this game. But you get an A for Effort. :D

Why can't you? Seems like you should be able to esp. if your producing tunes that you are selling. It's basically your brand.

Yeah me too. I remember reading something to the effect. I know if you have proof of performing in a certain area that someone else can't come in with the same name...
say there was a Rican in Chicago (which there is tho he goes by DJ Rican) and he was an established DJ... I could not be billed in Chicago as Rican... and visa versa...

can you find this?
Empath looked it up and said you can't TM an artist name, only a product name
John, I have trademarked "Edan" and "Edan Everywhere" with the USPTO. He may have meant copyrighted your name.
john c
2009-06-17, 03:57 PM
the Patent Office? really?
You can do a search for "Edan" or "Edan Everywhere" at uspto.gov and see for yourself if you don't believe me.
We also trademarked "4twenty4" and our logo.

I believe you certainly. But what is the "product" you submit to have a patent for?
I have 2 friends who work there also, so this is good news. Maybe they can facilitate it faster
and thanks for your input
It's a "goods and services" mark. Here's the wording for the mark "Edan."
Goods and Services IC 041. US 100 101 107. G & S: ENTERTAINMENT IN THE NATURE OF LIVE PERFORMANCES BY A DISC JOCKEY FOR PARTIES, CLUBS AND CONCERT-TYPE EVENTS. FIRST USE: 19940000. FIRST USE IN COMMERCE: 19980307
Here's the wording for "Edan Everywhere."
Goods and Services IC 009. US 021 023 026 036 038. G & S: Musical sound recordings, namely, prerecorded compact discs, phonograph records, and cassettes, all featuring music. FIRST USE: 20020401. FIRST USE IN COMMERCE: 20050501
BTW, I'll be happy to help if you have questions.
HAHA. Here's Scott Henry's, also a "goods and services" mark.
Word Mark SCOTT HENRY
Goods and Services IC 041. US 100 101 107. G & S: Entertainment services, namely live performances by a musical performer, namely the playing of recorded music by a disc jockey. FIRST USE: 20030315. FIRST USE IN COMMERCE: 20030315

awesome! how long did it take? and whats the fee? $300?
It really doesn't take all that long if you have everything in order ahead of time. If the filing attorney has questions they contact you stating you need to submit more evidence of the use of the mark or more information about how it's used in commerce. Also, if it closely resembles another mark it could take longer for you to clarify to the attorney how yours is not in conflict with the other. You'll need to submit samples showing the mark as a good or service (fliers, cds, records) are really good examples.
Unfortunately you'll need two separate marks for recording artist and live performing artist. Bummer.

random fact.
Their tunes (the house duo) rocked!
